Terms of use
These terms are an agreement between you and Boring Lava LLC ("we", "us") about using TV Casually: the app, its server and tvcasually.com. By using TV Casually you accept them. Our privacy policy explains how we handle your data.
1. Who can use TV Casually
You must be at least 13 years old, or older where your country requires it. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you.
2. Guests and accounts
You can use TV Casually without an account; your library is then stored only on your phone, and if you lose the phone or uninstall the app, it is gone. A guest library holds up to 10 shows. A free account removes that limit and adds backup and sync.
You are responsible for what happens under your account. Keep access to the email address, Apple Account or Google Account you sign in with secure. If you think someone else has used your account, use Settings → Sign out everywhere and tell us.
3. What's free
With a free account, tracking is unlimited: your library, marking episodes, history, Watching, Upcoming, search, reminders, sync, ratings and comments, achievements, basic statistics and recaps, import and export. We won't move these behind TV Casually Plus or limit how many shows or episodes you can track.
4. TV Casually Plus
TV Casually Plus is an optional subscription that adds features listed in the app, such as advanced statistics, fuller recaps, Smart Lists, themes and finer reminders. It belongs to your TV Casually account and works on every device you sign in to, so buying it needs a (free) account.
- Payment. You buy Plus through the App Store or Google Play. The price is shown in the app before you confirm, in your currency, and is charged to your Apple Account or Google Account when you confirm. The store's terms apply to the payment.
- Automatic renewal. Plus renews automatically at the end of each period (a month or a year) at the then-current price unless you cancel before the store's renewal deadline. Check the renewal date and cancellation terms shown by your store.
- Cancelling. Cancel in the store: on iPhone, Settings → your name → Subscriptions; on Android, Google Play → Payments & subscriptions → Subscriptions. Plus continues until the end of the period you paid for. Uninstalling the app or deleting your TV Casually account does not cancel a subscription.
- Refunds. Apple and Google handle payments and refunds under their own policies. You can ask Apple at reportaproblem.apple.com and Google through Google Play's refund page. If the store revokes a refunded subscription, Plus access ends when we receive the update.
- Free trials and offers. If we offer a trial or introductory price, the app says how long it lasts and what you'll pay afterwards. Unless you cancel before it ends, the subscription continues at the regular price.
- Price changes. If the price changes, the store tells you in advance, and where the store's rules require it, asks you to agree. A new price applies from your next renewal, never to a period already paid for.
- Restoring. On a new phone, sign in to the same TV Casually account, or use Settings → Restore purchases. A subscription belongs to the account it was bought for and can't be moved to another existing account.
- What's included can change. We may improve, add or replace Plus features. If we remove something important you paid for, you can cancel, and where the law gives you a right to a partial refund, we'll help you get it.
- If Plus ends, your data stays: Plus settings and Smart Lists are kept (unused) and come back if you subscribe again.
Nothing in these terms limits rights you have as a consumer under the law of your country, including any right to withdraw from a purchase.
5. Community rules
Episodes have ratings and a small discussion. Every comment is checked before anyone else sees it, which can take an hour or more. Comments may contain spoilers for the episode they're on; the app warns readers.
Welcome
Ordinary talk about TV, including strong opinions and bad language, harsh criticism of shows, writing, acting and networks, spoilers for that episode or earlier ones, jokes, and links to reviews or recaps.
Not allowed
- Threats of violence against real people or groups
- Harassment or abuse aimed at a real person, including other commenters and cast
- Attacks on people for who they are (race, ethnicity, religion, gender, sexuality, disability and similar)
- Any sexual content involving minors; graphic sexual content, or sexual content about real people
- Other people's private information, such as addresses, phone numbers or emails
- Scams, spam, malicious links, and nonsense posted to disrupt
- Spoilers for later episodes, when they're plain reveals
- Encouraging self-harm, or other content that puts people in danger
- Anything illegal, or that infringes someone else's rights
Moderation
An automated moderation model reviews each comment; uncertain ones may be checked again or withheld. We may decline to publish, hide or remove any comment that breaks these rules. Repeatedly breaking them can pause your commenting for a day, then a week, then a month, and serious or repeated breaks can end it for good. The rest of the app keeps working. A rejected spoiler is never held against you.
Reporting and blocking
Tap ⋯ on a comment and choose Report…, then a reason. A reported comment is reviewed again; it disappears for you right away, and comments reported by several people are hidden until the review. You can also block a person so you no longer see their comments. If something needs urgent attention, write to support@boringlava.com.
If you think we got a decision about your comment wrong, write to us and a person will look at it.
6. Your content
Your comments and ratings stay yours. By posting a comment you give us a worldwide, non-exclusive, royalty-free licence to store, moderate, display and distribute it within TV Casually for as long as it is published. You can delete your comments at any time. You promise you have the right to post what you post.
7. Using the service fairly
Don't:
- access TV Casually by automated means (scraping, bots) except through the app;
- overload, probe or interfere with our servers, or get around rate limits;
- copy, modify or reverse-engineer the app, except as the law allows;
- use TV Casually to break the law or anyone's rights;
- pretend to be someone else or create accounts to get around a restriction.
8. Show information
Show and episode information, posters and images come from TVmaze and are licensed under CC BY-SA. TV Casually isn't affiliated with or endorsed by TVmaze, or by any show, network or streaming service. Their names and artwork belong to their owners. Listings, air dates and times can be incomplete or wrong; corrections can be made on TVmaze and usually reach TV Casually within a day.
9. Ending your use
You can stop using TV Casually at any time and delete your account in the app (see Deleting your account). We may suspend or close an account that seriously or repeatedly breaks these terms, or where the law requires it. Unless the breach or the law prevents it, we will tell you why and give you a chance to export your history first. If we ever shut TV Casually down, we will give you at least 30 days' notice to export your history.
10. Changes
TV Casually will change over time. If we change these terms in a way that matters, we'll tell you in the app before the change applies. If you don't agree, you can stop using TV Casually and delete your account; continuing to use it means you accept the new terms.
11. Disclaimers
We work hard to keep TV Casually reliable and your history safe, but we provide it "as is" and "as available", without warranties of any kind beyond those the law requires. We don't promise it will always be available or error-free, that reminders will always arrive, or that show information is accurate. Export your history from time to time if it matters to you.
12. Limits of liability
To the extent the law allows, we are not liable for indirect or consequential losses, or lost data, profits or goodwill. Our total liability for any claim about TV Casually is limited to the greater of what you paid us for TV Casually Plus in the 12 months before the claim and $100.
Nothing in these terms excludes or limits liability that can't be excluded or limited by law, such as for death or personal injury caused by negligence, for fraud, or your statutory rights as a consumer.
13. Governing law
These terms are governed by the laws of Washington State, United States, and disputes go to the state or federal courts in Washington State. If you are a consumer living in the EU or the UK, you also keep the protection of the mandatory laws of your country and can bring a claim in its courts.
If any part of these terms can't be enforced, the rest still applies. If we don't enforce a term straight away, we haven't given up the right to.
14. App Store and Google Play
If you got TV Casually from the App Store:
- these terms are between you and us, not Apple, and we, not Apple, are responsible for the app and its content;
- Apple has no obligation to provide maintenance or support for the app;
- if the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the app; to the extent the law allows, Apple has no other warranty obligation for it;
- we, not Apple, are responsible for handling any claims about the app, including product liability claims, claims that it fails to conform to legal or regulatory requirements, consumer protection claims, and claims that it infringes someone's intellectual property;
- you confirm that you are not in a country subject to a US government embargo or listed as a prohibited or restricted party;
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
If you got TV Casually from Google Play, Google Play's terms of service also apply.
